Former NBA superstar Shaquille O’Neal is fighting back against a lawsuit filed against him and other celebrities accused of promoting the bankrupt cryptocurrency exchange, FTX. O’Neal claims that he was never properly served with legal papers, leading his legal team to request the dismissal of the case.
Class action attorney Adam Moskowitz had previously celebrated successfully serving O’Neal with notice of the lawsuit in April. However, O’Neal now contends that the service was inadequate. According to court filings, process servers allegedly threw the papers at O’Neal’s moving car, but they failed to physically hand them to him.
The lawsuit targets over a dozen celebrities, including Tom Brady and Steph Curry, accused of promoting FTX. O’Neal’s lawyers argue that despite his high-profile appearances on television and other media platforms, serving him with the legal notice proved challenging.
Moskowitz, the class action lawyer, countered O’Neal’s claims, asserting that the incident was captured on video. He even suggested that O’Neal may have attempted to harm the process server. O’Neal’s legal team has not yet responded to these allegations.
Now, the court will decide whether the purported service was sufficient or if the claims against O’Neal should be dismissed. The outcome of this dispute could have significant implications for the ongoing FTX lawsuit, as other high-profile defendants closely watch the proceedings.
